What is GNCTD Bill 2021: Know Its Features and Impacts

After a high-octane debate in the Rajya Sabha, the bill granting primacy to Delhi's Lieutenant Governor (L-G) over the elected government was passed, sparking outrage from the opposition and a walkout by MPs from the BJD, SP, Congress, and YSR-Congress.

On March 22, the Lok Sabha passed the Government of National Capital Territory of Delhi (Amendment) Bill, 2021, which clarifies that "government" in Delhi refers to the "Lieutenant Governor."

The "government" in the city, according to the bill would be the "Lieutenant Governor" (L-G) in the context of any legislation passed by the legislative assembly.
The bill also requires the Delhi government to seek the LG's opinion before taking any executive action.

What is GNCTD Bill?

The GNCTD Act was passed by the then-Congress government in 1991, and Delhi was designated as a Union Territory with "limited legislative powers."
However, the GNCTD Act Amendment 2021 clarifies that in Delhi, "government" refers to the "Lieutenant Governor."
The bill defines "government" in Delhi as the "Lieutenant Governor," and it requires the Delhi government to seek the LG’s opinion before taking any executive action.
The Rajya Sabha passed the Government of National Capital Territory of Delhi (Amendment) (GNCTD) Bill, 2021 on Wednesday amid widespread outrage and protest from opposition members.

Salient features of the GNCTD Bill

Know about the Significance of GNCTD Bill

  • The bill aims to amend the GNCT of Delhi Act, 1991, which establishes the framework for the Delhi Legislative Assembly's operation and renames the Delhi Government as the Lieutenant Governor (LG).
  • It limits the Delhi Assembly's ability to conduct business according to its own rules of procedure. It stipulates that the Rules of Procedure and Conduct of Business in the Delhi Legislative Assembly shall be consistent with the Rules of Procedure and Conduct of Business in the Lok Sabha.
  • The Bill also prevents the Legislative Assembly from enacting any rule that would allow it or its Committees to consider matters of day-to-day administration in the NCT of Delhi, and (ii) conduct an investigation into administrative decisions. Furthermore, any clause in effect that has the above-mentioned effect will be null and void.
  • Furthermore, the Bill stipulates that before taking any executive action on decisions made by the Delhi Government, the LG's opinion must be sought on such issues as the LG may specify.
