While he got his rank of Major General from his command of the Volunteer Army he never broke the rank of Lt. Colonel in the “regular US Army'’. He had been court martialed for a year (10 months actually), lost rank to a Captain and then regained rank of Lt. Colonel in the 7th Calvary.
