Preventive detention states that if a person is suspicious i.e. if a person is found doing something wrong against the national interest or maintenance of administration then he can be kept under custody for 3 months without trial. The concerned suspicious person also has some rights given by the Indian Constitution that state that the detention period can only be extended by an advisory board. The other right is that a person under preventive detention is not fully accused. The last right is that detention should be specified and the detainee has the right to make representation against the detention order. Preventive detention is a prevention measure. It is implied only in the case of the actions found against national interest, national security, and the maintenance of administration
