Malaysia has repealed the death penalty

Wan Junadi Tuanku Jaafar, Malaysia's Minister in the Prime Minister's Department, stated that capital punishment will be substituted by other forms of punishment at the discretion of the court.

The Cabinet has agreed to do additional studies and research into the suggested alternative penalties for 11 crimes that carry the mandatory death penalty, one crime under Section 39B of the Dangerous Act, and 22 crimes that carry the death penalty but are up to the court's discretion.

Malaysia's Death Penalty History

Although there is a moratorium on executions in Malaysia, capital punishment is a legal penalty. Drug trafficking, murder, acts of terrorism, treason, and, since 2003, rape resulting in death, are among the 33 capital crimes. Hanging is used to carry out executions.

The concept of capital punishment in Malaysia emerged from a combination of the common law system that Malaysia inherited during its time as British Malaya and the Islamic sanctioning of capital punishment.

Why should the death penalty be abolished?

The death sentence, according to the Human Rights Group, violates human rights, particularly the right to life and the right to live free of torture, cruel, inhuman, or degrading treatment or punishment.

The Universal Declaration of Human Rights, which was adopted by the United Nations in 1948, protects both of these rights.
