Malaysia has abolished the death penalty as a punishment.

Malaysia has agreed to eliminate the death penalty as an obligatory punishment and to replace it with a penalty that would be imposed at the discretion of the judges. The move is significant for Southeast Asia, where crimes such as drug trafficking, murder, kidnapping, terrorism, and firearm possession are all punished by death.

Following the presentation of a report on the investigation of alternative penalties for the required death penalty during a cabinet meeting on June 8, 2022, the Malaysian government agreed to remove the mandatory death penalty.

Zambia stated its intention to abolish the death penalty in May 2022. The United Nations Human Rights Council applauded the decision, noting that Zambia's plans to abolish the death sentence added to the increasing global clamour against the practice. Wan Junadi Tuanku Jaafar, Malaysia's Minister in the Prime Minister's Department, stated that capital punishment will be substituted by other forms of punishment at the discretion of the court.

The Cabinet has agreed to do additional studies and research into the suggested alternative penalties for 11 crimes that carry the mandatory death penalty, one crime under Section 39B of the Dangerous Act, and 22 crimes that carry the death penalty but are up to the court's discretion.

Although there is a moratorium on executions in Malaysia, capital punishment is a legal penalty. Drug trafficking, murder, acts of terrorism, treason, and, since 2003, rape resulting in death, are among the 33 capital crimes.
